Terms of Service
These terms are an agreement between you and PhotoCoach AI (“we”) governing your use of the PhotoCoach AI app (“the app”). By downloading, installing or using the app, you agree to these terms. If you do not agree, please do not use the app.
The app is distributed through Apple's App Store. Your use is also subject to Apple's terms; this agreement is between you and us, not with Apple, and Apple is not responsible for the app or its content.
1. License
We grant you a personal, limited, non-exclusive, non-transferable license to install and use the app on an iOS device you own or control, for personal, non-commercial purposes — unless otherwise agreed in writing.
2. Acceptable use
You agree not to:
- Use the app for any unlawful purpose or in violation of others' rights;
- Capture, edit or share images of other people without their consent;
- Use object removal or retouch to create misleading, falsified, defamatory or harmful content;
- Reverse-engineer, interfere with, disrupt, or attempt to gain unauthorized access to the app or its servers;
- Abuse the cloud services by automating large volumes of requests.
3. Your content and photos
You retain all rights to the photos and content you create with the app. We do not claim ownership of them. You are responsible for the content you capture, edit and share, including obtaining any necessary consent from people appearing in your photos. For the cloud features, you grant us a minimal, temporary right to process your photo solely to produce the result returned to you, as described in the Privacy Policy.
4. AI features and third parties
The app uses AI models, including third-party services, for object removal and retouch. AI-generated results are a creative aid and may be imperfect or unpredictable — quality depends on the input photo. You should review results before use, especially before publishing them. You may not use the AI features to create content that is unlawful or that infringes others' rights.
5. Subscriptions and payments
The app is free to download and includes free features. A Premium subscription unlocks the full app and is offered as weekly, monthly and yearly plans, with a 3-day free trial. Premium provides unlimited use of on-device features and includes a monthly allowance of cloud AI edits (AI erase and AI retouch); once the allowance is reached, those cloud features pause until the next period. Exact prices are shown in the app at the time of purchase and vary by region.
Subscriptions are billed through your Apple App Store account. Payment is charged at confirmation of purchase; unless canceled at least 24 hours before the end of the current period, the subscription renews automatically and your account is charged for renewal. You can manage or cancel your subscription in your App Store account settings. If you subscribe during a free trial, any unused portion of the trial is forfeited when you purchase a subscription. Refunds are handled by Apple according to its policy.
6. Intellectual property
The app — including its source code, interface, pose library, illustrations, logo and trademarks — is owned by PhotoCoach AI or its licensors and is protected by law. These terms transfer no ownership rights to you beyond the license above.
7. Disclaimer of warranties
The app is provided “as is” and “as available”, without warranties of any kind to the extent permitted by law. We do not warrant that the app will be error-free or uninterrupted, or that AI results will meet a specific quality standard.
8. Limitation of liability
To the extent permitted by law, we are not liable for indirect, incidental or consequential damages arising from your use of the app, including loss of data or photos. Our liability, if any, is limited to the maximum extent allowed by applicable law.
9. Suspension and termination
You may stop using and uninstall the app at any time. We may suspend or terminate access to the cloud services if we detect abuse or a violation of these terms.
10. Changes to these terms
We may update these terms from time to time. Updates take effect when posted on this page; significant changes will be announced in the app. Continued use means you accept the new terms.
11. Governing law
These terms are governed by applicable law. Nothing in these terms limits any mandatory consumer rights you have in your country of residence.
